SERVICES OFFERED BY KARNATAKA TOURSIM DEVELOPMENT CORPORATION ON THIS WEBSITE AND TERMS AND CONDITIONS GOVERNING THE SERVICES.

1. DEFINITIONS :

In this agreement the following words shall have the following meanings/interpretation/full form:
1.1 "e-Reserve" means the name of the online reservation system developed and hosted by PST Web Solutions Pvt.Ltd. Bangalore and licensed to KSTDC.
1.2 "KSTDC" means the service provider who operates and is responsible for the luxury train viz., 'The Golden Chariot'
1.3 "Websites" means the official websites of KSTDC viz., www.thegoldenchariot.org.in, www.goldenchariot.org, and www.thegoldenchariot.gov.in.
1.4 "User" means an individual, firm or entity who have accessed the portal/website of KSTDC and having read and accepted the terms and conditions of usage of the portal/website by clicking on the 'accept' button.
1.5 "e-Ticket" means any confirmation issued by us, through your use of our accommodation booking portal/website for your selected days of journey over the accommodation specified by the "operator". This could be an e-ticket you get printed from the portal/website, or what is obtained from authorized agents/franchisees of the operator.
1.6 "PNR" means the unique 10 digit number generated by the system on each and every successful booking.
1.7 'Payment Gateway' means the website of the credit card processing bank where you will be furnishing your credit card details for making payment towards the cost of service you have availed using our website.

2. SERVICES OFFERED :

The services offered by KSTDC on their portal/website are specified below. The same services will also be available through agents/franchisees of the operator at various locations. However these service providers may have made different restrictions / limitations in the packages offered and KSTDC is not responsible for any such limited service offered or for such differences in service between any two or more such service providers.

2.1 Advance reservation in any type or class of accommodation which are offered by KSTDC on full payment for both adults and children, for accommodation on any available departure subject to terms of accommodation specified by KSTDC.
2.2 General enquiries such as accommodation availability, tariff for various types or class of accommodation offered by KSTDC, check-in and check-out timings, discounts offered, accommodation availability etc.
2.3 On line cancellation of booked accommodations subject to cancellation rules set by KSTDC and the credit card issuing bank.
2.4 Issue of duplicate reservation vouchers.
2.5 Change of departure date and amendments to the bookings made

TERMS AND CONDITIONS OF SERVICE :

KSTDC provides the facility for transacting, reserving and issue of e-Ticket of accommodation booked through the internet and through the online reservation system installed and maintained by PST Web Solutions Pvt.Ltd. Reservation and booking of accommodation and all transactions through this portal/website shall be governed by special conditions imposed for internet based booking and by conditions set out by KSTDC from time to time.

The following terms and conditions will apply if you wish to use the portal/website of KSTDC's online reservation service developed and hosted by PST Web Solutions Pvt. Ltd. Please go through the conditions carefully and if you accept them, you may register and transact on the portal/website. Please note that a person or firm or entity cannot register on the portal/website more than once. Also please note that by registering yourself, you are deemed to have read and agreed/accepted all the terms and conditions set forth here. In case you do not agree or accept any of the terms and conditions set forth here, please do not transact on this portal/website. Once you have clicked the 'I Agree' button on the bottom of this Terms and Conditions, you have entered into a formal agreement with KSTDC for the purpose of transactions on this portal/website.

KSTDC's performance of this agreement is subject to existing laws and legal processes of Govt.of India, and nothing contained in this agreement is in derogation of KSTDC's right to comply with law enforcement requests or requirements relating to your use of this portal/website or information provided to or gathered by KSTDC with respect to such use. You agree that KSTDC may provide details of your use of the portal/website to regulators or police or any other third party, or in order to resolve disputes or complaints which relate to the portal/website, at KSTDC's complete discretion.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth herein, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

This agreement constitutes the entire agreement between the user and KSTDC with respect to this portal/website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and KSTDC with respect to this portal/website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

ACCOMMODATION BOOKING :

1.1 We agree to provide online accommodation ticket booking facility to registered users who agree to the terms and conditions set forth in this agreement.
1.2 The user can take a printout of the e-ticket and check-in and report to board the train without any further confirmation from KSTDC.
1.3 In all cases, please remember to carry a valid proof of identification.
1.4 We will provide you the service with utmost care and professionalism.
1.5 Booking of accommodation through the internet is available to registered users 24 hours a day and all the 7 days of the week. Nevertheless, service hours are liable to changes without any prior intimation.

2. ISSUE OF e-Tickets :

2.1 User Registration: You must be a registered user to use our portal/website to reserve, book and print any e-Ticket and for any type of enquiries. Only persons above the age of 18 can register as a user. A user can register only once on this portal/website. All payments towards the cost of the accommodation and the service charge, if any, will be through AXIS Bank or any other payment gateway provided in the payment page of the portal/website. The portal/website is a VeriSign secured and your credit/debit card details is transmitted through the internet in a fully encrypted (128 bit, browser independent encryption) form. Further, your credit card account details are not stored in our portal/website. You will be redirected to the payment gateway maintained by the credit card processing bank to furnish details of your credit card. Upon successful payment with the credit card processing bank, you will be redirected to our website from where you can print out the e-Ticket.
2.2 The misuse of Credit Card/ Internet Banking Access details is a criminal offence under Indian 'The Information Technology Act, 2000'. We will aggressively pursue and prosecute all transactions that attempt misuse of Credit Card/ Internet Banking Access details. As part of our strict security checks we track every transaction for its genuiness. For 'Fraud Protection', it is recorded that the IP Address of the current transaction is: xx.xx.xxxx.xx and Date & Time is: dd/mm/yyy and at XXXXhrs IST.
2.3 Accommodations can be booked upto a reasonable time set by KSTDC.
2.4 KSTDC makes no guarantee that any service will be uninterrupted, timely, secure or error-free.
2.5 You may make a booking for an individual or a group but upto a maximum of 3 rooms at one time. Further a registered user will not be allowed to book more than 2 times (for upto 3 rooms at a time) in a calendar month.
2.6 A registered user can chose his type of room and type of bed from the selection. Your booking will be confirmed online and on successful receipt of payment from the payment gateway viz., AXIS Bank or any other payment gateway, the system will generate a unique Reference number or PNR for each booking (upto 3 rooms) Booking of tickets is subject to realization of the full tariff and the service charge, if any (incl.of service tax) from the payment gateway viz., AXIS Bank or any other payment gateway. You will be responsible for all charges, fees, duties, taxes and assessments arising out of your use of this portal/website. If, for any reason, the booking does not materialize, the entire amount debited from your credit/debit card account will be credited back to your account. If you want to try for the same booking again, it will be treated as a fresh one.
2.7 If for any reason, you are not able to print out the booked accommodation, you will find the details of the booked accommodation on the left menu under 'booked history' from which link you can take a print out. Each booked accommodation will have a unique PNR number. Please also carry a proof of identification for verification by the Train check-in staff. The Train staff has the right to refuse accommodation if guest/s are different from the original booking.
2.8 KSTDC and the Train check-in staff are not responsible for any wrong bookings due to incorrect details furnished by the user.

3. YOUR OBLIGATIONS :

3.1 You shall access our portal/website only for lawful purposes and you shall be responsible for complying with all applicable laws, statutes and regulations in connection with the use of our portal/website. This portal/website is for your personal and non-commercial use. You shall not modify, edit, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information, products or services obtained from this portal/website. You shall not create a hyperlink to the portal/website or 'frame' the portal/website, except with the express advance written permission of KSTDC.
3.2 All information provided by you on the 'registration page' must be accurate and complete and all fields marked * (mandatory) must be filled. KSTDC reserves all rights to disclose any or part of such information's provided to satisfy any applicable law, authorities, legal processes, any central/state/local government/bodies.
3.3 You may use this portal/website only for legitimate bookings and you may not use the same for any sort of commercial resale and profit. Without limitation, any speculative, false or fraudulent booking in anticipation of demand is prohibited and KSTDC has the right to refuse accommodation of such guests with such e-Tickets.
3.4 Non-authorization of payment more than twice by the payment gateway for accommodation booked by you is liable to result in cancellation of your registration with us and will be done without any notice to you.
3.5 By registering with us, you confirm that you are of legal age as prescribed by law to enter into such agreements and that all the information you have provided us at the time of registration is true and to best of your knowledge and belief. You are responsible for the security of the 'user name' and 'password' sent to you upon the first registration and since these are transmitted on encrypted mode, even KSTDC will have no knowledge about the same. KSTDC will not be responsible for any financial loss, inconvenience or mental agony resulting from misuse of your user id/password/credit, debit card number/account number details for bookings made on this portal/website.
3.6 KSTDC shall use reasonable endeavors to check the accuracy of the information posted on this portal/website for the Train, but give no warranty as to the accuracy of such information and reserve the right to amend and vary the contents of this portal/website from time to time without prior notice. The portal/website may also contain links to third party websites and which are not under the control of KSTDC and as such KSTDC will not be responsible for the contents of such sites, including without limitation any link contained in a linked site or any changes or updates to a linked site. KSTDC will not be responsible for any transactions with such third party links including advertisers or promotional offers, services, payment for delivery of goods/services etc and is solely between you and the third party link promoters. KSTDC will not be responsible or liable for any part of such dealings or promotions.
3.7 The maximum amount of our liability to you for all loss or damage arising out of use of our portal/website and the service whether in contract or tort shall be limited to the value of the accommodation booked through your use of this service.
3.8 KSTDC shall not be liable to you in respect of any short coming in performance of these terms and conditions or breach of the terms and conditions due to any event or circumstances beyond our reasonable control.
3.9 KSTDC may at any time at our sole discretion and without giving any reason or any prior notice terminate or temporarily suspend your access to all or any part of the portal/website.
3.10 This agreement and your use of the portal/website is governed by Indian Law and the courts of Bangalore, India. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Bangalore and all disputes arising out of relating to the use of the KSTDC portal/website.
3.11 This agreement including any document referred to herein constitutes the entire agreement between us and you in respect of your use of this service.
3.12 All content and software that is made available to view and/or download in connection with the KSTDC sites/services, excluding content and /or software that may be made available by end users through a communication service is owned by and is the copyrighted work of KSTDC and PST Web Solutions Pvt. Ltd and/or its suppliers and is protected by copyright laws and international treaty provisions.
3.13 Nothing in this agreement shall operate so as to create a partnership, joint venture, an agency relationship or employment of any kind between you and us.
3.14 All rights not expressly granted herein are reserved.
